1. Vi phạm ICCPR, ICESCR, CAT, UDHR, ICERD, ICCPR điều 18 và các Công ước bảo vệ Người bảo vệ nhân quyền—mà Việt Nam đã phê chuẩn.
2. Sử dụng Điều 117/331 BLHS, luật An ninh mạng, hạn chế tự do ngôn luận, báo chí, hội họp và tôn giáo—gây ra việc bắt giữ chính trị, án bỏ túi, xét xử không minh bạch, biệt giam, tra tấn, như đã được VCHR-FIDH nêu trong Shadow Report trình UN HRC định kỳ 7–8/7/2025 hrw.org+3fidh.org+3english.vov.vn+3queme.org+1fidh.org+1 và Human Rights Watch 7/7/2025 .
3. Vi phạm cam kết trong EVFTA, hiệp định PCA và Nghị quyết Nghị viện Châu Âu yêu cầu cải cách luật Việt Nam, đề nghị giám sát nhân quyền và xử lý trường hợp của Hoàng Thị Minh Hồng .
Yêu cầu mạnh mẽ từ cộng đồng nhân quyền quốc tế:
1. Cuộc điều tra công khai & độc lập, có sự bảo trợ của UN Human Rights Committee, Nghị viện Châu Âu, ICC, CEDH, về các hành vi đàn áp tự do ngôn luận, báo chí, hội họp, tôn giáo.
2. Áp dụng chế tài Magnitsky toàn cầu với các quan chức chịu trách nhiệm—đóng băng tài sản, hạn chế nhập cảnh.
3. Thả ngay và vô điều kiện mọi tù nhân lương tâm, nhà báo/blogger/tôn giáo bị kết án theo quy định mơ hồ.
4. Thúc đẩy tiến trình chuyển đổi ôn hòa, dựa trên tam quyền phân lập, nền đa nguyên, bầu cử tự do, lập ra cơ quan nhân quyền độc lập như EP yêu cầu (cụ thể: giám sát EVFTA/PCA, điều tra án bỏ túi, công khai hóa điều 117/331/331a…) .
5. Giám sát áp dụng khuyến nghị UPR, khuyến nghị ICCPR 2019, tiếp nhận quan sát viên quốc tế (Đặc phái viên LHQ, giám sát ĐCSV, UNGPs…).
Cơ sở pháp lý & tiền lệ quốc tế:
· ICCPR 1982 & các khuyến nghị năm 2019 về tự do biểu đạt, hội họp, tôn giáo english.vov.vn+1fidh.org+1.
· Nghị quyết EP 17.12.2015, 21.01.2021, 8.5.2025 yêu cầu Việt Nam cải cách luật, thả tù chính trị, hỗ trợ giám sát nhân quyền .
· EVFTA/PCA: Điều khoản Nhân quyền, yêu cầu phương thức kêu gọi độc lập và giải quyết khiếu nại; là cơ sở để EU có thể áp dụng biện pháp đối với Việt Nam fidh.org.

We, defenders of human rights, democracy, and religious freedom, hereby submit to you undeniable evidence of:
1. Violations of the ICCPR, ICESCR, CAT, UDHR, ICERD, particularly Article 18 of the ICCPR and other UN Conventions on the protection of human rights defenders — all of which Vietnam has ratified.
2. Use of Articles 117 and 331 of the Penal Code, the Cybersecurity Law, to restrict freedom of expression, press, assembly, and religion — leading to political arrests, sham trials, incommunicado detention, torture, as documented in the Shadow Report submitted by VCHR & FIDH to the UN Human Rights Committee (July 7–8, 2025) and corroborated by Human Rights Watch (July 7, 2025) (hrw.org, fidh.org, english.vov.vn, queme.org).
3. Violations of Vietnam's commitments under the EU–Vietnam Free Trade Agreement (EVFTA), the Partnership and Cooperation Agreement (PCA), and several European Parliament Resolutions, including the case of Hoàng Thị Minh Hồng.
Urgent Recommendations from the Global Human Rights Community:
1. Launch an independent and public investigation, under the auspices of the UN Human Rights Committee, the European Parliament, ICC, and ECtHR, into systematic violations of freedom of expression, press, religion, and association.
2. Apply the Global Magnitsky Sanctions on responsible Vietnamese officials – including asset freezes and travel bans.
3. Demand the immediate and unconditional release of all prisoners of conscience, independent journalists, bloggers, and non-state religious followers.
4. Promote a peaceful political transition in Vietnam based on the separation of powers, free multiparty elections, and the creation of an independent national human rights body, as called for by the European Parliament (specifically: monitoring EVFTA/PCA compliance, investigating sham trials, repealing or amending Articles 117/331/331a...).
5. Ensure strict follow-up on UPR recommendations, ICCPR 2019 observations, and acceptance of international observers (UN Special Rapporteurs, civil society monitors, UN Guiding Principles on Business & Human Rights...).
Legal Foundations & International Precedents:
· ICCPR (ratified by Vietnam in 1982) & 2019 recommendations on freedom of expression, religion, and assembly (english.vov.vn, fidh.org).
· European Parliament Resolutions: 17.12.2015, 21.01.2021, and 08.05.2025 demanding Vietnam reform its laws, release political prisoners, and enable human rights monitoring.
· EVFTA / PCA: Human rights clauses require independent grievance mechanisms and legal remedies — allowing the EU to take appropriate measures against Vietnam (fidh.org).
Conclusion:
The struggle for freedom and the restoration of the Republic of Vietnam is long and arduous. Yet, with international solidarity, firm commitment to human rights, and the support of global civil society and media, justice will ultimately prevail.

Nous, militants des droits humains, de la démocratie et de la liberté religieuse, soumettons à votre haute attention les preuves irréfutables de :
1. Violations des pactes ICCPR, ICESCR, CAT, DUDH, ICERD, notamment l’article 18 du Pacte international relatif aux droits civils et politiques, et autres conventions protégeant les défenseurs des droits — toutes ratifiées par le Vietnam.
2. Usage répressif des articles 117 et 331 du Code pénal, de la loi sur la cybersécurité, pour réprimer la liberté d’expression, de la presse, de réunion et de religion — entraînant arrestations arbitraires, procès expéditifs, détention au secret et actes de torture, comme documenté dans le rapport parallèle de VCHR & FIDH soumis au Comité des droits de l’homme de l’ONU (7–8 juillet 2025) et confirmé par Human Rights Watch (7 juillet 2025).
3. Non-respect des engagements pris dans le cadre de l’EVFTA, de l’Accord de partenariat et de coopération (APC), et des résolutions du Parlement européen, notamment sur le cas de Hoàng Thị Minh Hồng.
Recommandations urgentes de la communauté internationale :
1. Ouvrir une enquête indépendante et publique, sous l’égide du Comité des droits de l’homme de l’ONU, du Parlement européen, de la CPI et de la CEDH, sur les violations des libertés fondamentales.
2. Appliquer les sanctions Global Magnitsky aux responsables vietnamiens — gels d’avoirs, interdictions de visa.
3. Libérer immédiatement et sans condition tous les prisonniers de conscience, journalistes indépendants, blogueurs et croyants persécutés.
4. Encourager une transition politique pacifique, fondée sur la séparation des pouvoirs, des élections libres et pluralistes, et la création d’une autorité indépendante des droits de l’homme, comme exigé par le Parlement européen (notamment : surveillance de l’EVFTA/APC, transparence sur les articles 117/331…).
5. Superviser l’application des recommandations de l’EPU, des observations ICCPR 2019, et accepter des observateurs internationaux (rapporteurs spéciaux de l’ONU, mécanismes de contrôle, Principes directeurs des Nations Unies…).

· Résolutions du Parlement européen : 17.12.2015, 21.01.2021, 08.05.2025 sur la réforme juridique et la libération des prisonniers politiques au Vietnam.
· EVFTA / APC : clauses des droits humains impliquant des mécanismes de plainte indépendants — autorisant l’UE à prendre des mesures adéquates (fidh.org).
Conclusion :
La lutte pour la liberté et la restauration de la République du Viêt Nam est difficile. Mais avec la solidarité internationale, l'engagement pour les droits humains, et la pression conjointe des médias et de la société civile, la justice triomphera.
